1.      Terms & Conditions

(a)        Tones Barber Shop website (the ‘website’) is owned and operated by C.M.Emery trading under the titles of Tones Barber Shop and Great Grooming..
(b)        All of the goods on this website are offered by Tones Barber Shop (‘we/us’) which will be the contracting party for any order that you place.
(c )       These Terms and Conditions of Sale apply to all transactions for the sale of goods on the website. Please read them carefully. They do not affect your statutory rights.
(d)        We may change these terms and conditions at any time. Any change will take effect from the date posted on the website.

2.         Prices & Promotions

(a)        Although we endeavour to ensure that all pricing information on the website is accurate, occasionally an error may occur and goods may be wrongly priced. If we discover a pricing error we will, at our discretion, either; contact you and ask you whether you wish to cancel your order, or continue with the order at the correct price; or notify you that we have cancelled your order. We will not be obliged to supply goods at the incorrect price.
(b)        We reserve the right to adjust prices, offers, goods and specifications of goods on the website at our discretion at any time before (but not after) we accept your order.

3.         Ordering

(a)        You will have an opportunity to correct any input errors in your order up until the point that you click the button on the checkout. It is the customers responsibility when using the website to ensure that all information is correct.
(b)        All orders made by you through the website are subject to acceptance by us. We may choose not to accept your order for any reason and will not be liable to you or to anyone else in those circumstances.
(c )       After submitting an order to us you will be sent an order acknowledgement e-mail confirming the goods that you have ordered. Please note this e-mail is an acknowledgement not an acceptance of your order.
(d)        For some goods information concerning stock availability may not be available on the website. If you order goods, which are not available from stock, we will contact you by e-mail and you will have the option to wait until the goods are available from stock, purchase an alternative product or cancel your order in accordance with our cancellation and returns policy. In the event your order is cancelled, we will refund any payment already collected from you in respect of that order, in accordance with our cancellation and returns policy.
(e)        Any e-mail or other electronic acknowledgement by us of receipt of an order placed by you does not constitute legal acceptance by us of your order. Acceptance of your order brings into existence a legally binding contract between the parties.

4.         Right to Withdraw Goods  

(a)        We reserve the right to withdraw any goods from the website at any time
(b)        We will not be liable to you or anyone else for withdrawing any goods from the website.

5.         Payment

(a)        Tones Barber Shop accepts payments through the PayPal Website Standard Payments service. All major credit and debit cards are accepted through this service. The customer’s credit card details are transmitted directly to PayPal’s secure server which processes card transactions from the website. Payment details are captured within PayPal’s secure EPDQ infrastructure and at no time do Tones Barber Shop employees or any person connected with Tones Barber Shop see any details of your credit or debit card.
(b)        Payment by cheque and postal order will need to be cleared before goods are dispatched.

6.         Delivery & Risk

(a)        We dispatch the items ordered by you, as they are available using the method of delivery specified. The delivery charge is as set out under Purchasing/Postage.

Delivery in USA, Africa, Australia, Middle & Far East, rest of the world

It is the responsibility of the customer to ensure someone is available to sign for the delivery. We will not be responsible for non-delivery where no-one is available to sign or the parcel is not collected from the Sorting Office. In these circumstances the goods will be returned to Tones Barber Shop and postage will have to be re-paid by the customer to ensure re-dispatch.
(b)        We cannot be held responsible if the delivery address given is incorrect.
(c )       We will use all reasonable endeavours to ensure that the estimated delivery times are met but we cannot accept any liability for late deliveries, which are due to circumstances outside our reasonable control.
(d)        Once you have received the goods, all risk of damage to, or loss of, the goods shall pass to you. If you intend to cancel your order in accordance with the cancellation and returns policy, you must keep good care of the goods pending their return to us.
(e)        You will be liable for goods incurring customs charges.
(f)         If your parcel is not received within 15 days within the UK and 30 days outside the UK under normal postal working conditions you will need to download and complete the Lost in Transit form on the website under Purchasing & Postage.

7.         Cancellation & Returns

(a)        Legal Compliance
This returns and refunds policy is in accordance with the EU Distance Selling Directive which came into force in October 2000 and is part of UK law under the Consumer Protection (Distance Selling) Regulations 2000. This law applies to all transactions within the UK where a consumer does not meet the vendor. Contracts between businesses are not governed by these regulations.
(b)        Your rights as a consumer
In accordance with the law, you have a 7 day ‘cooling off period’ in which you have the right to cancel your purchase and receive a full refund, subject to delivery costs that we have incurred. You do not need to give a reason for cancelling your purchase. We are obliged to refund your payment in full within 30 days of your cancellation. All products should be returned unused, unopened and in a re-saleable condition.
(c )       How to cancel within the 7 day cooling off period

8.         Refunds due to Cancellation

(a)        Should you cancel your purchase within this 7 day ‘cooling off’ period we will refund your payment in full, subject to any delivery costs we have incurred.
(b)        If your order qualified for free postage we will refund minus the normal postage charge.
(c)        If you paid through PayPal your refund will be made through PayPal if you paid by any other means your refund will be made by cheque which will be posted to you within 30 days of your cancellation.
(d)        There will be no charges for cancellation within this 7 day ‘cooling off’ period. All products must be returned unused, unopened and in a re-saleable condition.

9.         Returns and refunds outside the 7 day ‘cooling off’ period

(a)        Refunds will only be made where the goods are returned unused, unopened and in re-saleable condition. Goods must be returned to us within 7 days of delivery.  
(b)        We cannot accept liability for goods lost or damaged in transit. You must wrap the goods carefully to avoid damage. You must return the goods by Recorded delivery, Registered post or courier service.
(c)        Proof of postage will not be accepted as proof of delivery. You need to include your name address and a copy of your purchase receipt.
(d)        Please note that the cost of returning unwanted goods is your responsibility.
(e)        For Health & Safety & Hygiene reasons refunds and/or exchanges will not be available for used products such as shaving razors, shaving brushes, manicure, pedicure or nasal items.

10.       Faulty or damaged items

(a)        If the product you receive is faulty contact us immediately at Customer Liaison – tonesbarbershop@btinternet.com and return the item to us using Registered or Recorded delivery. Once the item is received if on inspection it is found to be faulty Tones Barber Shop will replace the item with the same or equivalent and refund the postage paid by you in returning the item.

11.       Privacy Policy

(a)        We respect your right to privacy we pass no information to other parties other than as part of the service we provide to you or as required under UK law.
(b)        We will only collect details about you when you place an order. These will include your name and address, your e-mail address and any other details needed to complete your order. We do not collect any information which may be deemed ’sensitive personal data’ under the Data Protection Act  1998.
(c )       Your submission of an order is deemed to be your consent to provide us with your details. We use no other means of data collection.

10.       Severance

(a)        Each provision of these Terms and Conditions of Sale shall be construed separately and independently of each other and the validity of any part shall not affect the validity of any other part.

11.       Law

(a)        These Terms and Conditions of Sale shall be governed by the laws of England and you agree to submit to the non-exclusive jurisdiction of the English courts. We are required by law to inform you that sales can be concluded in English only and that no other public filing requirements apply.

12        Goods Colours & Colour Reproduction/Website Images

(a)        Customers must accept that the photographs made available on the website are as accurate as possible but are provided for information purposes and intended as a guide to prospective customers.
(b)        Copyright to the website including all images and written content is the property of Tones Barber Shop and as such is protected under national and international law. All rights are reserved and no material may be reproduced without prior written consent.
(c)        Tones Barber Shop is a wholly independent organisation. It has no connections or affiliations to any other organisation retail or wholesale that may trade on the Inter-Net, E-Bay or elsewhere. The organisation uses the titles of Tones Barber Shop and Great Grooming only and any other claims, inferences or suggestions are spurious.
